In these Terms and Conditions:

"We", and "Us" and “Cocosa” mean Cocosa Lifestyle Limited Ltd Company Registration Number 07640503 of 1 Brunel Road, Earlstrees Industrial Estate, Corby, Northants, NN17 4JW.
“Products” means goods sold by Cocosa on this website.
“Price” means the price at which the Products are sold on this website.
“Order” means an order for Products on this website.
“Recommended Retail Price” means a price for the Products for comparison purposes, as further explained in ‘Reference to Recommended Retail Prices on our website’ below.
“website” means

These Terms and Conditions together with your Order constitute the entire contract (“Terms”) between Cocosa and you for the supply of Products. No other Terms and Conditions will apply. The Terms cannot be varied unless we agree to vary it in writing or by email.

Please read these Terms carefully and make sure that you understand them, before you sign up to and order any Products from our website.Please note that on signing up to the website you will be asked to agree to and accept these Terms. Website Access to and use of this website and the Products and services available through the website (collectively, the "Services") are subject to these Terms. By using the Services, you are agreeing to all of the Terms, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms.

Cocosa is part of the MYSALE GROUP PLC (“Mysale”). By signing up as a member to Cocosa the member acknowledges that they will become a member of the MYSALE GROUP PLC of companies and agrees that they may be contacted by any of its subsidiaries. This does not affect a member’s ability to unsubscribe from communications from these companies on an individual basis.

UK Sales Only
We only sell and ship Products within UK. We will not make deliveries outside of UK.

Copyright in the entire website, and all copy, images, logos, indicia, text, content, and unique method of showcasing products therein is the intellectual property of MYSALE. The name of Cocosa, MYSALE Group Plc or any of their respective trademarks or logos may not be used without advance specific, written prior permission of the Mysale Group Plc.

We have done our best to display as accurately as possible the colours of the products shown on this website. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

Correction of Errors and Inaccuracies Limitations on Quantity
Whilst Cocosa makes every reasonable effort to present accurate information on this website, the information may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability. We also reserve the right to limit quantities (including after you have submitted your order). We apologize for any inconvenience this may cause you. If you are not fully satisfied with your purchase please see our returns policy below for details on how to obtain a refund.

You must indemnify and hold Cocosa and its employees, representatives, agents, affiliates, directors, officers, managers and shareholders (the "Parties") harmless from any damage, loss, or expense (including without limitation, attorneys' fees and costs) incurred in connection with any third-party claim, demand or action ("Claim") brought against any of the Parties arising out of or in connection with any of these Terms and Conditions. If you have to indemnify Cocosa under this Section, Cocosa will have the right to control the defence, settlement, and resolution of any Claim at your sole expense. You may not settle or otherwise resolve any Claim without express written permission from Cocosa.

Legal Capacity To Transact
By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. If you are under the age eighteen (18) years you cannot place orders with Cocosa. Should Cocosa suffer any damage or other losses as a result of a transaction entered into by a minor, Cocosa reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Cocosa.

Placing Your Order
You may place an Order by adding items to "My Account" on the website and clicking the "Check Out" button. Items will remain in your Cart for a period of 20 minutes. Once this time has elapsed the Cart will empty if there is no further activity. We are unable to place an order on your behalf or accept orders via any other means. When you place your Order, we will issue you with an Order Number. We will do this by email. By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions. Information contained on the Cocosa website constitutes an invitation to treat. No information on our website constitutes or should be deemed as an offer by us to supply any products, however Cocosa will make every effort to supply products to you. We will notify you that your order is being processed by sending you an Order Confirmation via email, however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. Cocosa and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. We will confirm acceptance of your order when your order status moves to dispatched in the My Account My Orders Section. If we cannot process or accept your Order after payment is received we will contact you by email.

Payment Methods And Processing
Cocosa uses Voice Commerce Trading Ltd as well as Cashflows and HSBC Bank to provide a secure environment for the authorisation of credit card and charge card transactions. Confidential information including card details are encrypted using industry standard SSL 128-bit encryption technology.

Priority Membership
Once Priority Membership has been used to purchase any item or enter a ‘Priority Members’ only sale, ‘Priority Membership’ is non-refundable.
Cocosa reserves the right in its sole discretion to cancel, terminate, modify or suspend the priority member package, and/or if necessary to provide alternative benefits to the same value as original benefits, subject to any written directions under applicable State or Territory legislation.

Cocosa will use its best endeavours to list Products with the most competitive prices. Cocosa reserves the right to change prices for Products displayed on the Cocosa website at any time.

Reference to Recommended Retail Prices on our website
Our Products are sourced from within the EU, USA, Australia and Asia. As such some may not be available for sale in the UK. This means that there may be no UK Recommended Retail Price for some Products. Where we have been able to establish that a Product is for sale in the UK, we have used that product’s market price as the Recommended Retail Price. In other cases, a Recommended Retail Price (RRP) has been established by converting the price in the market from which the goods were sourced into GBP. The exchange rate used in conversion to GBP is that which is applicable at the time the goods are first landed in the UK as published by our bank.RRP’s are provided by our supplier as the original selling price within the supplier’s distribution network. This price is provided for comparison purposes only.

Each Cocosa Voucher is personal to the User receiving it, is not transferable, has no monetary value and under no circumstances can it be converted into currency. Each Cocosa Voucherhas an expiry date which cannot be modified.
The use of a Cocosa Voucher requires the total value of the order (excluding shipping and handling costs) to be higher than the monetary value of the discount given by the Cocosa Voucher. Some discount Cocosa Voucher's may specify a minimum spend in order to be used. In this case, the monetary value of the order (excluding delivery costs) has to be higher than the minimum spend.

Under no circumstances can the value of a discount Cocosa Voucher be deducted from an order if that Cocosa Voucher is defective or out of date: no replacement Cocosa Voucher's will be issued.

When an order is placed using a discount Cocosa Voucher and it contains a number of items, the value of the discount is spread over each item according to the pro-rated value of that item. Any refund of an item bought in such an order will be reduced by the value of discount attached to it.
We reserve the right to modify or amend at any time these guidelines and the methods through which benefits are earned. We reserve the right to disqualify you at any time from participation in our Cocosa Referral Program and remove any existing Cocosa Vouchers from your account.

Supply Of Your Products
Subject to these Terms and Conditions, we will supply to you the Products indicated on your Order Confirmation. All orders and products are subject to availability. When we are unable to supply products for any reason we will inform you via e-mail to the e-mail address supplied to us at registration. When an entire order is unable to be fulfilled you will be refunded for the whole order inclusive of shipping and handling charges. When an order is partially unfulfilled the remaining products will be supplied and your shipping and handling charges will remain unaltered. When your Order items have been dispatched, we will confirm shipment via the My Account My Orders section including a tracking number for each parcel.

Restricted Products
By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. If you are under the age eighteen (18) years you cannot place orders with Cocosa. Should Cocosa suffer any damage or other losses as a result of a transaction entered into by a minor, Cocosa reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Cocosa.
It is against the law to sell or supply intoxicating substances, such as alcohol, or to sell any knife, knife blades or razor blades to persons under the age of 18 years of age in the UK, the Republic of Ireland and The Channel Islands. The purchase of items with age restrictions will require proof. By placing your order you confirm that you are at least 18 years of age, however we may contact you to verify your age. Should we not receive adequate assurances, proof of age or have reason to believe that you are not 18 years of age or over we may cancel the order. When such items are delivered the delivery partner may request proof of age at that point. Where insufficient identification is available the delivery partner may retain the goods.

Delivery Of Your Products
Cocosa is a specialist online retailer and we do not always carry stock in our warehouse. On many occasions we source products that are held by suppliers in their own warehouses. As we source products from around the World delivery times will vary. We will use our best efforts to ensure your order arrives as soon as possible after the end of the sale. Delivery will be made via a number of partners and the estimated delivery times will be indicated within each specific sale according to the dispatch location. We use the best possible estimated dates given the information we have been provided by our suppliers and partners, however many factors are outside of our control and we cannot guarantee delivery within this time frame. Individual order status can be tracked in the My Account, My Orders section. We charge shipping and handling for each sale you purchase from unless otherwise stated on the website. Due to the nature of our business, we may consolidate orders where possible from more than one sale. For these orders shipping and handling charges will remain unaltered. Equally if you order from multiple sales then due to numerous and potentially different locations of stock your items may not arrive at the same time. Title and risk of loss to all products will pass to you on delivery unless otherwise specified in the Direct Import Goods Clause.

For the avoidance of doubt, In the event that there is any ambiguity relating to the passing of risk and title to the goods, risk and title to the goods will pass to you on the first attempt at delivery irrespective of whether it was successful or not.

Authority To Leave Delivery
By selecting No and clicking Accept on our Signature on Delivery option you authorise the courier to leave the goods unattended at the delivery address and you accept that once the courier has done so, the complete order has been received. Selection of Authority to Leave is deemed by our couriers as a signature from the recipient.

Cocosa Ltd and couriers associated with the delivery, do not accept responsibility for any loss or damage which results from the Authority To Leave delivery method. You agree to release Cocosa Ltd from and against any and all claims, demands, liabilities, losses, costs and expenses if Authority To Leave is selected.

Should the courier be unable to leave the parcel or deem the location to be an unsafe area to leave the parcel or your instruction text is unclear, the courier may leave an attempted delivery card and return the parcel to their depot. Risk and title to the goods transfers to you after the first attempt at delivery irrespective of whether it was successful or not.

Your Rights To Return A Product
You have a legal right to cancel an Order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 during the period set out below. This means that, during the relevant period, if you change your mind or decide for any other reason that you do not want to receive or keep a Product, you can notify us of your decision to cancel the order and receive a refund.

You have the right to cancel your order at any time before dispatch of the item(s) or within 14 days of receipt of the item(s) (or the last separate item ordered) by following our returns process explained below under “Returns Policy”. However if your order is in “Delivery Requested” or “Dispatched” status we will be unable to cancel the order as the item(s) are being prepared to be sent or have already been sent to you. In the event that this happens please follow the returns process to return the item(s) to us so that we can arrange for a refund. To cancel an order, please contact our Customer Service Team by emailing us via the “Contact Us” tab on our website (found within ‘Your Account’). We will email you to confirm we have received your cancellation as soon as possible. If you are e-mailing us please include details of your order to help us to identify it. If you send us your cancellation notice as described above, then your cancellation is effective from the date you send us the message.


Change Of Mind

A Return Authorisation Number (RAN) is required for all returns.

You will be entitled to a refund provided you return the item to us without undue delay and in any event within 14 days of the date you notify us of your cancellation .The item must be returned to us in brand new condition, with the relevant Product being exactly as it was when you received it. All Products must be packed in the original, unmarked packaging including any accessories, manuals, documentation and registration that shipped with the Product. Please note that this cancellation right does not apply in the case of:

(a) perishable items, tailor made or personalised items (such as earrings or underwear)
(b) sealed audio or sealed video recordings or sealed computer software, once these Products are unsealed after you receive them or
(c) any Products which become mixed inseparably with other items after their delivery.

We regret that we currently cannot facilitate exchanges.
If you cancel your order we will:
(a) refund you the price you paid for the Products. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount
(b) refund any delivery costs you have paid, although, as permitted by law, the maximum refund will be the costs of delivery by the least expensive delivery method we offer (as applicable)and
(c) make any refunds due to you as soon as possible and in any event within the deadlines indicated below:
(i) 14 days after the day on which we receive the Product back from you or, if earlier, the day on which you provide us with evidence that you have sent the Product back to us OR
(ii) if you have not received the Product, 14 days after the date on which you inform us of your decision to cancel the order.
1.2 We will refund you on the credit card or debit card used by you to pay. If you used vouchers to pay for the Product we may refund you in vouchers. If a Product has been delivered to you before you decide to cancel your order:
(a) You can send it back. Our Customer Service will explain how to arrange a return and
(b) Unless the Product is faulty or not as described (in this case, see below), you will be responsible for the cost of returning the Products to us.
Because you are a consumer, we are under a legal duty to supply Products that are in conformity with your order. As a consumer, you have legal rights in relation to Products that are faulty or not as described. These legal rights are not affected by your right of return and refund set out in these Terms, or anything else in these Terms.

Faulty Items
If your item arrives faulty or you find a defect arises after delivery, please contact our Customer Service department by emailing us on: “Contact Us”. Each case will be assessed on case by case basis.
Depending on the fault, you may be offered the choice of a refund, repair or replacement of the Product (subject to availability). Return postage of faulty Products to be assessed will be at Cocosa’s expense.

If you have returned the Products to us because they are faulty and chose to receive a refund, we will refund the price of the Products in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to us.

Incorrectly Described Items
Cocosa works hard to present the products on our Websites as accurately as possible. As much as we try to avoid it, on some occasions the information on our Websites may contain inaccuracies. We make no warranty or representation that the information provided by our suppliers, including in relation to product descriptions, is correct, accurate, complete or reliable. However, please contact our Customer Service team if you have received an item that has not been correctly described.

In the event that it is verified that you have received an incorrectly described item, you will be entitled to a refund.

If you have returned a Product to us because it is incorrectly described and chose to receive a refund, we will refund the price of the Product in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to us.

Some Products - Manufacturer Only Warranty
Some Products sold through Cocosa are serviced and supported exclusively by their manufacturer in accordance the warranty information provided on the Product listing.
Cocosa is not a manufacturer of products. However, in the event of a failure, our Customer Service staff would be happy to forward the relevant item to the manufacturer or any relevant agent and liaise with them on your behalf, if you so choose. However, it may be more convenient for you to liaise with the manufacturer directly. If you require any assistance in doing so, our customer service team would be happy to assist you. Please contact our Customer Service department via “Contact Us”. A manufacturer's guarantee is in addition to, and does not affect, your legal rights in relation to Products that are faulty or not as described.

Computer Hardware - Exclusions and Limitations
Cocosa is not liable for any damage to or loss of any programs, data, or other information stored on any media contained within electronic or computing Products. Recovery and reinstallation of system and application software and user data are not covered under any Cocosa warranty. In relation to any computing media Product, or any computing hardware Product or computing part contained within a Product, Cocosa will not be responsible for direct, special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including but not limited to lost profits, downtime, goodwill, damage to or replacement of equipment and property, any costs of recovering, reprogramming, or reproducing any program or data stored in or used with Cocosa Products supplied to you, and any failure to maintain the confidentiality of data stored on the Product. Cocosa specifically does not represent that it will be able to repair any Product under warranty or make a Product exchange without risk to or loss of programs or data. Where a computing Product needs to be returned to Cocosa for replacement or a refund, Cocosa will in no manner whatsoever be responsible for any data you may leave on the computing Product.

Our Liability
You acknowledge that we do not make any warranty or representation as to the suitability of Products for any purpose we exclude all other implied terms and warranties, whether statutory or otherwise, relating to the Products to the fullest extent permitted by law and we will not be liable to you for indirect and/or consequential loss arising from or connected to these Terms in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data, loss of goodwill or any other indirect or consequential commercial or economic loss of any kind) unless such loss arises as a result of our own negligence or wilful misconduct.
Our liability to you for loss or damage of any kind arising out of these Terms or in connection with the relationship established by it is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statue or otherwise. Our total liability to you in respect of all losses arising under or in connection with your order, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the Products. Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence (b) fraud or fraudulent misrepresentation (c)breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession) or (d) defective products under the Consumer Protection Act 1987.

We only supply the Products for domestic and private use. You agree not to use the product for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Your Data - Use And Protection

You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of Cocosa. Any unauthorized assignment shall be deemed null and void. If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby. Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition. Cocosa reserves the right to change the Terms and Conditions of sale at any time. No Cocosa employee or agent has the authority to vary any of the Terms and Conditions governing any sale. A person who is not a party to these terms and conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions

1.3 These Terms (including all of the policies and other agreements described in these Terms and Conditions, which are hereby incorporated herein by this reference) contain the entire understanding of the parties regarding its subject matter, and supersede all prior and contemporaneous agreements and understandings between the parties regarding its subject matter. No failure or delay by a party in exercising any right, power or privilege under these Terms and Conditions will operate as a waiver thereof, nor will any single or partial exercise of any right, power or privilege preclude any other or further exercise thereof or the exercise of any other such right, power, or privilege.. The invalidity or unenforceability of any provision of these Terms and Conditions will not affect the validity or enforceability of any other provision of these Terms and Conditions, all of which will remain in full force and effect. We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights or our obligations under these Terms. You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
1.4 These Terms are a contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

Force Majeure
Cocosa shall not be liable for any failure to perform or delay in performing any of its obligations under these Terms and Conditions that is caused by an event outside Cocosa’s control, and Cocosa shall be entitled to a reasonable extension of time for the performance of any such obligations Where the event outside our control affects our delivery of Products to you, we will arrange a new delivery date with you after the event outside our control is over.

Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England & Wales and shall be subject to the exclusive jurisdiction of the courts of England & Wales.
